We at Talk Hiring, Inc. (“Talk Hiring”, “we”, “us” or “our”) know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways. In certain cases, we may also share some Personal Information with third parties, but only as described below.

As noted in the Terms of Use https://www.talkhiring.com/terms-of-use, we do not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. Information You Provide to Us:
We receive and store any information you knowingly provide to us, including without limitation Registration Information. For example, if you are a Candidate and click on a link or call a phone number contained in an Invitation and participate in an Automated Interview, we may collect Personal Information such as your name, email address, phone number, and any Personal Information you may provide in response to prompts or questions you hear during your Automated Interview. You understand that Talk Hiring will record, transcribe, and process any statements you make during an Automated Interview, and share Interview Records and Interview Results based on those statements with (a) the Employer that sent, or had Talk Hiring send on such Employer’s behalf, the Invitation initiating such Automated Interview, and (b) any Recipient to whom you grant or allow access to an Interview Report or Report Link corresponding to such Automated Interview. You should not provide us with any Personal Information that you do not want to share with us or with an Employer or a Recipient. We will never ask you for, and you should not provide to us, any sensitive Personal Information (including, for example, your Social Security number, your passport number or other government-issued identification number, or other proof of eligibility for employment in the United States).

If you are an Employer, you represent and warrant that any Personal Information you provide to us, including without limitation any names, telephone numbers, email addresses, or other Personal Information relating to candidates for employment, has been obtained and is provided by you in compliance with (a) all applicable laws, rules and regulations, including, without limitation, any and all applicable privacy and data protection laws, the Telephone Consumer Protection Act (“TCPA”), the Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003, (“CAN-SPAM”), and the Do-Not-Call Implementation Act, and any rules established by the Federal Communications Commission, and (b) any contractual duties to which you are bound that relate to use and disclosure of such information, including, without limitation, any applicable privacy policies, as stated in our Terms of Use https://www.talkhiring.com/terms-of-use. If you do not have permission under applicable laws, rules, or regulations or any contractual duties to share certain Personal Information with us and/or to use the Services to send an Invitation or to have Talk Hiring send an Invitation on your behalf, or if the individual to whom certain Personal Information relates has requested that you not share such information with us, please do not do so! If you do, you will be deemed in violation of our Terms of Use https://www.talkhiring.com/terms-of-use, which expressly prohibit such sharing.

We may communicate with you if you’ve provided us the means to do so, or if you have made your contact information available to an Employer. For example, if you as a Candidate have given an Employer permission to provide us your phone number or email address, we may send you a SMS, MMS and/or other text message notification (each a “Text Message”) or email inviting you to participate in an Automated Interview (such Text Messages or emails “Invitations”). We may also send you an email to ask for any feedback, suggestions, improvements, enhancements, and/or feature requests relating to the Services. You can stop and prevent the further receipt of communications from us at any time. You can stop us from sending you Text Messages at any time by texting “STOP” to 646-798-4337. You can stop us from sending you emails at any time by clicking the “unsubscribe” button at the bottom of any email we send you or emailing us at hello@talkhiring.com.
If you are an Employer, any payment information you provide, such as your credit card or debit card type, number, and expiration date, is collected and stored by our third-party payment processing company, which is currently Stripe, Inc. (“Stripe”), and use and storage of that information is governed by Stripe’s own terms of service (which may found at https://stripe.com/us/terms) and privacy policy (which may be found at https://stripe.com/us/terms and https://stripe.com/us/privacy. If you register a credit card as your payment method, we may collect your credit card’s last four (4) digits and/or customer verification number for verification purposes only, and in any case, will not have access to your complete credit card information.

Information Collected Automatically
Whenever you interact with our Services, including without limitation when you click on a link or call a phone number contained in an Invitation, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” information, the type of browser and/or device you’re using to access our Services, and the page or feature you requested. [“Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features.]

Information Collected From Other Websites and Do Not Track Policy Through cookies we place on your browser or device, we may collect information about your online activity after you leave our Services. Just like any other usage information we collect, this information allows us to improve the Services and customize your online experience, and otherwise as described in this Privacy Policy. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Services and after you leave our Services.

Will Talk Hiring Share Any of the Personal Information it Receives? We may share your Personal Information with third parties as described in this section: Employers: If you are a Candidate and use the Services to initiate and conduct an Automated Interview, we will share your Personal Information, including your Interview Records and Interview Results based on same, with the Employer who initiated the delivery of your Invitation. If you later choose to apply to another job, you may submit a request to share your Personal Information with a new Employer by contacting us at hello@talkhiring.com, in response to your request, we may send your Personal Information, including your behavioral interview responses, to the new Employer. Candidates: If you are an Employer, or using the Services on behalf of an Employer, and use Talk Hiring to send Invitations to individuals or to have Talk Hiring send an Invitation on your behalf, we will share your entity or individual name, email address, and telephone number with such individuals. Recipients: If you are a Candidate and grant or allow a third party access to your Interview Reports or Report Links, we will share you’re the Interview Records and Interview Results corresponding to such Interview Reports or Report Links, and any Personal Information contained in same, with such third party through the Services.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you; for example, we may use a communication platform to send or receive Text Messages or transactional emails, a processing company to record a Candidate’s interview for us, a transcription company to convert a Candidate’s recording into written form/text, a web-based server to store interview files. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.

Information that’s been aggregated and anonymized. We may aggregate and anonymize your Personal Information such that you are not identified as an individual, and provide that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage or de-identified information to a partner (or allow a partner to collect such information) in a manner that would identify you as an individual person. Analytics service providers. To support and enhance the Services, we use third-party analytics services, including those provided by Google Inc. (“Google”), Mixpanel, Inc. (“Mixpanel”), Amplitude, Inc. and AutopilotHQ, Inc. (collectively, “Third Party Analytics Services”) to analyze how you interact and engage with the Services so that we can learn and make enhancements to offer you a better experience. The Third Party Analytics Services use cookies, web beacons and/or other technologies to collect information about your use of the Services and other websites, and they may track your activity on the Services and other websites over time. Information collected by the Third Party Analytics Services may include your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. Information from Third Party Analytics Services may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver content targeted to your interests on our Services and other websites and better understand your online activity. Google’s Inc.’s ability to use and share information collected by Google Analytics about your use of the Services is subject to the Google Analytics Terms of Use and the Google Privacy Policy. You have the option to opt out of Google’s use of cookies by visiting the Google advertising opt-out page at www.google.com/privacy_ads.html or the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout/. You have the option to opt out of Mixpanel’s analytics services by visiting https://mixpanel.com/optout/. Please note that if you get a new computer, install a new browser, delete or otherwise alter your browser’s cookie file (including upgrading browsers), you may clear the Mixpanel opt-out cookie. Affiliated Businesses: In certain situations, businesses or third party websites we’re affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

Business Transfers: We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party. Your Personal Information is protected by Talk Hiring using industry-standard technical and organizational measures. You must prevent unauthorized access to your Personal Information by appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.
We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

How can I update or delete my Personal Information?
In some cases, you may contact us at hello@talkhiring.com to update or delete the following information you’ve provided to us:

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Information to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at hello@talkhiring.com.
What choices do I have?
You can always opt not to disclose information to us, but keep in mind some information may be needed to take advantage of some of our features.
You may be able to update or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. Some information may remain in our records after your deletion of such information. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
